Rental Terms And Conditions Agreement

Las Olas is operated and made available for vacation Rentals through Luxury Ocean Rentals, Inc. Luxury Ocean Rentals (LOR) is a Florida Sub-S Corporation offering short- term rentals under Chapter 509 of the Florida Statutes.

Guest agrees to provide credit card authorization upon check in to guarantee recovery of any damage from guests’ use of the accommodations other than normal wear and tear. Guest will be fully responsible for the expenses incurred by Luxury Ocean Rentals, Inc due to damages. The guest who makes the arrangements for such rental and or signs the Rental Terms and Conditions Agreement, shall be fully responsible for any and all other Guest involved in the reservation.

Occupancy is restricted to the stated occupancy limit Noted in the Rental Terms and Conditions Agreement. Over- occupy of the accommodation is a breech of the Rental Agreement. Guest agree to register all people in their party in advance and agree that they will be in default of this agreement if they have more guest in the accommodation than stated in the agreement. Las Olas is only available to family groups, married couples and responsible adults over the age of 21. Violation of the above Agreement will be grounds for immediate eviction without refund of the rent or deposit.

Pets or evidence of a pet on the premises will result in forfeiture of the entire rent and deposit and will be grounds for immediate guest eviction.

Upon making your reservation 25% of the full rental payment shall be due. The balance of the rental payment shall be due two weeks prior to check in. Included in your rental rate quote on your confirmation letter shall be the cleaning charge if applicable and any additional guest fees. Party's over 5 require two golf carts. Additional Golf Cart fee is $200 per Week or $35 per day. A $500.00 credit card authorization shall be placed upon Check- In for possible damage or incidental charges. If there are any charges incurred after checkout from damages or incidental charges, then these charges may be applied to the credit card on file.

The Guest agree that Luxury Ocean Rentals does not guarantee occupancy of such accommodation until 4:00 pm on the day of check-in and the guests agree that check out time is 10:00 am. Guests may request a late check out in advance. We may charge the guest an extra day’s rental rate, but we reserve the right to deny any late check out request if it does not fit into our Guest occupancy schedule. We will make reasonable effort to accommodate all guest requests.

Seasonal and Holiday rentals of 15 days or longer require a 90-day notice of cancellation or date change. Failure to give a 90-day notice for these rentals will result in forfeiture of the down payment (25% or more of total rent). Seasonal and Holiday rentals of 14 days or less require a 60-day notice of cancellation or date change. Failure to give a 60-day notice for these rentals will result in forfeiture of the down payment (25% or more of the total rent). There will always be a $47.00 cancellation penalty or 3% of the gross rental amount charged (whichever is greater) for all reservations cancelled within the terms stated above. We recommended the purchase of travel insurance that covers unexpected cancellation. THERE ARE, NO REFUNDS for early departure. Reimbursement for hurricanes will only be given under mandatory evacuation ordered by County officials. Date changes must be received 30 days prior to the reservation for your deposit to be transferred. If less than 30 days notice is given, the deposit (25% of total rent) will be forfeited.

Guest understand and agree that golf cart drivers must be 16 years of age or older. Guest must use the same precautions and follow the same rules as when operating a motor vehicle. Guest shall utilize proper care and will not abuse the golf cart or operate them in any manor in violation of any motor vehicle Laws. If guest are found abusing the golf cart, we reserve the right to take the cart away from the guest with no refund due. Guest will be charged for any damage to the golf carts. Guest will not operate golf carts with more than 5 adults and / or children. Guest will not exceed weight limitations of golf cart. Guest shall hold LOR and the property homeowner harmless from any and all damages and/or injuries from use of the golf cart. Golf cart use is at your own risk. Please use proper precautions as guest are fully responsible for all injures and damages to golf cart.

A housekeeper supply package will be included in your rental, which will include ample supplies for your stay. Any additional supplies must be purchased at the Island grocery. Cleaning of the unit will be included in your rental fee for weekly rentals. Guest will be responsible for keeping the home tidy during their stay. Upon completion of your stay at Las Olas, Housekeeping will strip all beds, vacuum, dust, clean the bathrooms, mop all floors, clean all appliances, sliding doors, sweep exterior decks and stairs. If the unit is exceptionally dirty, there may be additional charges for cleanup deducted from your deposit. Maid services are available upon request for an additional fee. Housekeeping cleaning fee will apply to all rentals less than one week in duration.

Luxury Ocean Rentals, Inc. (LOR) does not guarantee any specific accommodation due to unforeseen incidents, but will make every effort possible to contact the guests if any unforeseen incident should cause “Las Olas” to not be available for the rental period, LOR will try it’s best to offer the guest equal and/or better accommodation or will refund 100% of the guest money.

Outdoor grills are prohibited on decks, porches and beaches. Outdoor grills will only be used at the grill area provided.

LOR makes a good-faith effort to offer a high quality accommodation and will make every reasonable effort to provide such accommodation represented to guest in top condition. Due to the nature of the Hospitality business, we cannot guarantee that items will not break from normal wear and tear. In case of a problem, please call 954-328-9803. LOR will attempt to correct any incident in a reasonable period of time. We cannot guarantee air conditions, televisions, appliances and so forth. NO REFUND OR RATE ADJUSTMENT will be made for mechanical failures.

Telephone and a fax machine are provided for your convenience for local calls only. Long Distance and directory assistance calls must be made collect, or charged to your personal phone or credit card.

Guest acknowledges and agrees to be responsible for all transportation arrangements and to be responsible for payment of any fees for their transportation to and from the Island.

Satellite reception on the unit's televisions may not always be available. This situation should be a short- term inconvenience only. Remember we are on an Island. NO REFUND OR RATE ADJUSTMENTS.

While we retain the services of a pest control technician, due to the nature of the climate of Upper Captiva Island, it is not always possible to guarantee a total absence of any insects.

Should the swimming pool or heater for the pool develop a problem, we will do our best to make timely repairs, but due to the fact that we are on an Island, repair may take up to 7 days. NO REFUND OR RATE ADJUSTMENT.

Luxury Ocean Rentals, Inc. reserves the right to refuse accommodations or services to any person that is objectionable, undesirable and/or in violation of any of the terms and conditions of the rental agreement. Such refusal shall not be based upon race, creed, color, sex, physical disability, or national origin.

Guest herewith acknowledge and agree to protect, defend, indemnify and hold harmless Luxury Ocean Rentals, Inc., And Homeowner, from any liability for damages and/or personal injury arising out of the use of the Homeowners’ rental property and golf cart.

I AGREE TO ALL OF THE ABOVE RENTAL TERMS AND CONDITIONS FOR THE VACATION RENTAL OF “ LAS OLAS”. I AGREE TO BE RESPONSIBLE FOR ANY DAMAGES MY GROUP MAY INCUR DURING OUR STAY. MY CREDIT CARD WHICH IS LEFT ON FILE WITH MY CONCENT AND/ OR MY DAMAGE DESPOSIT CAN AND WILL BE USED FOR REIMBURSEMENT OF DAMAGES IF NECESSARY.
